LiveMeUp's Privacy Policy aims to provide you with all the information about how LiveMeUp collects and processes your Personal Data. The Privacy Policy is part of the General Terms of Use (GTU), and each term defined in the GTU has the same meaning in the Privacy Policy. By accessing and using our website and the LiveMeUp software suite, you agree to familiarize yourself with this Privacy Policy, which may be modified or updated at any time without notice. Any changes will be posted on the Website, and we recommend checking it regularly.

I. PURPOSES OF PROCESSING AND NATURE OF COLLECTED DATA

1.1. We collect and process data that you voluntarily provide to us in order to access and use the Software, make requests to our teams (such as demonstrations or others), or access our online resources. We also collect and process data related to user preferences and traffic (such as IP addresses).

Specifically, we process your Data to enable you to:
- Access our website
- Create an account to access the Software and use our services
- Register for online demonstrations or our events
- Download our online resources
- Improve our services by placing cookies on users' devices.

To open an account, you must provide us with at least the following personal identification information to use the Software:
- Your name
- Your email address
- Your phone number.

You can supplement your profile with other Personal Data (address, another phone number, date of birth, photo, name of your clients or prospects, etc.). We will never collect or process sensitive Personal Data as defined by regulations, such as racial or ethnic origin, political opinions, religious or philosophical beliefs, union membership, health, etc.

1.2. We automatically collect certain data when you visit the website livemeup.io. For example, information regarding the origin of the connection, the type and version of your web browser, the duration of your connection, etc.

We use cookies for the Website and the Customer Relationship Management platform called LiveMeUp. A cookie is a small text file sent by the website visited by the User in their web browser or on the device used. Its function is to allow the site to function, facilitate navigation (remember technical choices and past activity), improve the use of the site and the service, and better understand User experience. The maximum lifespan of a cookie is 13 months.

II. USE OF YOUR PERSONAL DATA

We only use Personal Data in cases provided by current regulations, which are:
- Execution of the service contract relating to your use of the LiveMeUp Software suite
- Compliance with a legal obligation
- Your consent to use your data.

III. PROCESSING OF PERSONAL DATA

LiveMeUp collects and processes your Personal Data fairly and lawfully, in accordance with the principles of the European Regulation 2016/679 of April 27, 2016 (GDPR). LiveMeUp is responsible for processing your Personal Data within the meaning of the GDPR.

LiveMeUp has designated a Data Protection Officer (DPO) who continuously monitors LiveMeUp's compliance with GDPR principles and rules, and who you can contact at contact@livemeup.io.
The DPO's responsibilities include:
- Informing and advising the Data Controller on the application of the GDPR within the company
- Raising awareness among LiveMeUp employees about the protection of User Personal Data
- Assisting them in the implementation of processing
- Responding to requests related to the exercise of your rights, in accordance with Article VIII.

IV. RETENTION OF YOUR PERSONAL DATA

4.1. Security
LiveMeUp takes all necessary measures to prevent the loss, misuse, intrusion, unauthorized disclosure, alteration, or destruction of the Personal Data you provide us.

Thus:
- Data is stored on servers hosted within the Microsoft Azure France infrastructure. Server security and the update of our operating software are carried out in real-time.
- All information you transmit to us is encrypted [TLS V1.3 protocol].
- LiveMeUp employees are bound by obligations of confidentiality and non-disclosure and have all signed a specific commitment regarding the protection of Personal Data.
- Access to your Data is subject to strict access control, restricted to authorized personnel under defined conditions.
- When we use service providers to process Personal Data, we have verified in advance that these providers guarantee an equivalent level of security protection.

4.2. Duration
LiveMeUp retains your Personal Data in accordance with the following legal and regulatory provisions:
- We keep information related to the management of the Client account, orders, billing, payments for 10 years after the end of the contract or the last contact from the inactive Client.
- We keep information related to the creation and management of prospecting files for 3 years from the last contact from the prospect.
- We keep the Data of inactive Clients for the purpose of sending information about our commercial and marketing offers, within 3 years after the end of the Business relationship.
- We are required to retain for 1 year the following Personal Data resulting from the creation, modification, or deletion of User Content:  
- Connection identification  
- Terminal-issued identification  
- Types of protocols  
- Nature of the operation  
- Date and time of the operation  
- Identification used by the operation author.

When the retention of Data is no longer justified by the management of a Client account, a legal obligation, business requirements, the establishment, exercise, or defense of our rights in court, or when you request it by exercising one of your rights (Article VIII), we securely delete your Data.

4.3. Account Cancellation
You can also request the deletion of your account in accordance with the GTU. Your Data will then be deleted in accordance with Article 4.2 above.

V. ACCESS TO YOUR PERSONAL DATA

5.1. Access to your Data by LiveMeUp Group Employees
Depending on the purposes defined in Article I, employees of the customer service, support, administrative, accounting, technical, marketing & sales services of the LiveMeUp Group may have access to Personal Data.

Access to your data is based on individual access authorizations, as specified in Article 4.1.

5.2. Data Transmission
LiveMeUp may subcontract the following services:
- Hosting
- Sending postal or digital mail
- Customer relationship management
- Maintenance
- Technical developments

In accordance with Article 28 of the GDPR, access to your Data by our subcontractors is provided and framed by a contract. This contract that binds us to our subcontractors lists the various regulatory obligations imposed on them regarding the protection of Personal Data.

VI. TRANSFER OF YOUR PERSONAL DATA

We keep your Personal Data within the European Union.If the Data we collect should be transferred to subcontractors located in other countries, we ensure in advance that appropriate safeguards are provided to frame any transfer of Personal Data (such as the European Commission's Standard Contractual Clauses with additional security guarantees), in accordance with the GDPR and the recommendations of the European Data Protection Committee.

We may also provide the Personal Data of our Users only if required by French law or ordered by a French court.

VII. LIVEMEUP COMMUNICATIONS

7.1. We may send you emails to the email address associated with your account for reasons related to our business relationship, such as technical or security reasons, administrative matters related to your subscription to the Software, your participation in our events, or to inform you about changes in our service offering.

7.2. We may also send you SMS or emails containing promotional and marketing offers under the conditions mentioned in Article VIII. If you unsubscribe from these communications, you will still receive the communications listed in Article 7.1.

VIII. EXERCISE OF USER RIGHTS

In accordance with the French "Informatique et Libertés" law and the European Regulation 2016/679 of April 27, 2016 (GDPR), which came into effect on May 25, 2018, you have the following rights regarding data processing:
- Right of access and rectification
- Right to object
- Right to erasure
- Right to data portability
- Right to restrict processing
- Right to organize the fate of your digital data after death.

You can exercise these rights by writing to the following postal address: LiveMeUp - 8 allée des charmes 59420 MOUVAUX or by writing directly to our DPO at contact@livemeup.io. Any request must be motivated and accompanied by a copy of a valid ID.

You can also:
- Modify your Personal Data directly from your LiveMeUp account, if you have one.
- Manage the receipt of promotional communications (not related to a transaction) by simply clicking on the "unsubscribe" link at the bottom of emails sent by LiveMeUp.
- Manage the receipt of SMS by sending a text message "STOP."
